Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity, and "you" refers to that entity.

Description of the Service

WAJ provides an all-in-one business management platform for salons, spas, barbershops, clinics, and similar businesses, including features such as appointment booking, staff and shift management, inventory, payments, marketing, customer relationship management, accounting, and an online business profile. We may add, modify, or remove features from time to time.

Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, current, and complete information when registering and to keep it up to date.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@waj.ai if you suspect any unauthorized use of your account.

Subscriptions, Billing, and Payments

Certain features of the Service are offered on a subscription basis. By subscribing to a paid plan, you authorize us (or our third-party payment processors) to charge the applicable fees using your selected payment method.

Subscription fees are billed in advance on a recurring basis (for example, monthly or annually) and are non-refundable except where required by law or expressly stated otherwise. Unless you cancel before the end of the current billing cycle, your subscription will automatically renew at the then-current rates.

We may change our fees at any time. We will provide reasonable advance notice of any fee change, which will take effect at the start of the next billing cycle.

Free Trials

We may offer a free trial of the Service. At the end of the trial period, unless you cancel, your subscription may automatically convert to a paid plan and your payment method may be charged. We reserve the right to modify or discontinue free trials at any time.

Acceptable Use

You agree not to misuse the Service. In particular, you agree not to:

• violate any applicable law, regulation, or third-party rights;
• upload or transmit malware, or otherwise interfere with or disrupt the integrity or performance of the Service;
• attempt to gain unauthorized access to the Service, other accounts, or related systems or networks;
• reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
• use the Service to send unsolicited communications (spam) or to harass, abuse, or harm others;
• resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.

Customer Data and Privacy

You retain all rights to the data that you and your customers submit to the Service ("Customer Data"). You grant WAJ a limited, worldwide license to host, process, and use Customer Data solely to provide and improve the Service and as otherwise described in our Privacy Policy.

You are responsible for ensuring that you have all necessary rights and consents to collect and process the personal data of your customers through the Service, and for complying with applicable data-protection laws. Our collection and use of personal data is described in our Privacy Policy, available at waj.ai/privacy-policy.

Intellectual Property

The Service, including all software, text, graphics, logos, and trademarks, is owned by WAJ or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. No rights are granted to you other than as expressly set out in these Terms.

Third-Party Services and Integrations

The Service may integrate with or link to third-party products and services (for example, payment processors, messaging providers, and mapping or content widgets). Your use of those third-party services is governed by their own terms and privacy policies, and WAJ is not responsible for them.

Service Availability and Modifications

We strive to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may suspend, modify, or discontinue all or part of the Service, perform maintenance, or impose limits on certain features, with or without notice.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WAJ DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAJ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. WAJ'S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO WAJ FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify and hold harmless WAJ and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

Term and Termination

These Terms remain in effect while you use the Service. You may stop using the Service and cancel your account at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a risk to WAJ, the Service, or others.

Upon termination, your right to use the Service will cease. We may delete your Customer Data after a reasonable period in accordance with our Privacy Policy and applicable law. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws principles. You agree that the courts located in Dubai, United Arab Emirates will have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection laws that may apply to you.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
